Any further use, including use by any other person other than the User having access through the User’s identification and password, constitutes acceptance of this terms. IF YOU DO NOT AGREE WITH THIS TERMS PLEASE DO NOT USE ANY OF THE SERVICES PROVIDED THROUGH THIS SERVICE.

1.        BACKGROUND AND PURPOSE.
The purpose of the MTN InsightPlus service (this “Service”) provided by MTN Service Provider (Proprietary) Limited (“MTN”) is to provide you (the “User”) with a guide and operational view of your usage, expenditure and/or cost(s) of various MTN services provided to you.

2. INDEMNITY.

2.1        The User agrees to indemnify, hold harmless, and defend MTN, its affiliates, employees, agents, content providers and service providers, against any and all claims, liabilities, damages, costs including but not limited any claims relating to the accuracy of information contained on the Service and/or any claims relating to any delay in updating the User’s expenditure and/or arising from or relating to any use of the services provided herein and through this Service.

2.2        Any material, information or data downloaded from or obtained through the use of this Service, is at your own risk, and MTN shall not be responsible for any damage to your computer system, software or loss of data that may result as a result thereof.

3. WARRANTIES.

3.1        Whilst MTN has made every effort to ensure that the information provided herein is current and accurate, MTN cannot warrant that the information contained on the Service is accurate and/or correct at all times.

3.2        It is expressly noted that this Service is provided as a guide to costs for usage of the services provided to the User and in no way substitutes the monthly or weekly statement reflecting the User’s actual final billing amount sent to the User by MTN. The statement sent to the User by MTN shall constitute the full and final statement for which the User shall remain liable to settle. The User acknowledges and agrees to remain liable to settle the final amount as indicated on the final statement sent to the User by MTN.

3.3        This Service is provided on a best effort, ‘as available’ and ‘as is’ basis. MTN, its affiliates and suppliers or anyone of their employees, do not warrant or guarantee the availability of the services available through this Service and make no representations, whether express or implied, and assume no liability or responsibility for the proper performance of these access control measures. In particular MTN makes no warranty that the access controls will meet your requirements, be secured or error free. MTN will however inform the User upon reasonable notice should this Service not be available for any reason whatsoever, which notice will be published on the MTN InsightPlus website including on www.mtn.co.za.

3.4        MTN reserves the right to vary these terms and conditions at any time upon reasonable notice which will be published on the MTN InsightPlus website. The standard terms and conditions available at www.mtn.co.za form part of these terms. The clauses of these terms must not be read in isolation of each other.

4. CONFIDENTIALITY.

4.1        Your information will be kept confidential to full extent permitted by law. Please note, however, that the relevant MTN support staff will have access to your personal information solely for purposes of maintenance of this Service, for example, while assisting and attending to your queries. Please remember to always keep your login username and password, provided to you ONLY, confidential at all times.

4.2        MTN will use its best effort and exercise reasonable care and use measures reasonably available to MTN to maintain the integrity, confidentiality and privacy of the services provided through this Service without allowing any unauthorized access. However, the use of this Service is provided on an ‘as is’ and ‘as available’ basis and is provided without warranties of any kind, either express or implied

5        Termination of Service.

5.1        MTN may, in its sole discretion, at any time, suspend or terminate the operation of this website or any products or services provided through this Service on 7(seven) Calendar Days written notice to you which shall be placed on the following website: http:\\insightplus.mtn.co.za.

5.2        User may terminate the Services by providing MTN with 30(thirty) Calendar Days written notice to business@mtn.co.za of its intention to terminate this service.
